3.3.3. Krax Style is not responsible for losses arising from unauthorized account access resulting from the customer’s failure to maintain account security.
4. Orders and Acceptance

4.1.1. An order is submitted when the customer completes the checkout process and payment is successfully authorized or otherwise accepted by the payment processor.
4.1.2. Submission of an order does not automatically require Krax Style to produce, accept, or fulfill the order.

4.3.2. Final acceptance occurs only when Krax Style proceeds with production, processing, or fulfillment.
4.4. Right to Refuse Service

5. Customer-Provided Content
5.1. Definition of Customer-Provided Content
5.1.1. “Customer-Provided Content” includes any content submitted, uploaded, entered, transmitted, or otherwise supplied by the customer, including:

5.1.1.3. Logos
5.1.1.4. Illustrations
5.1.1.5. Graphics
5.1.1.6. Artwork
5.1.1.7. Slogans
5.1.1.8. Names
5.1.1.9. Quotes
5.1.1.10. Text
5.1.1.11. Symbols
5.1.1.12. Designs
5.1.1.13. Digital files
5.1.1.14. Any other media or instructions supplied for customization
5.2. Customer Responsibility for Content
5.2.1. The customer is solely and exclusively responsible for all Customer-Provided Content.
5.2.2. Krax Style does not create, endorse, verify, or independently investigate Customer-Provided Content unless it expressly chooses to do so.
5.2.3. The customer assumes all legal responsibility for ensuring that Customer-Provided Content is lawful and authorized for use in connection with the requested product.
5.3. Customer Representations and Warranties
5.3.1. By submitting Customer-Provided Content, the customer represents and warrants that:
5.3.1.1. The customer owns the content or has obtained all rights, permissions, licenses, releases, and approvals necessary to use the content.
5.3.1.2. The content does not infringe, misappropriate, or violate any copyright, trademark, patent, trade dress, publicity right, privacy right, contractual right, or other intellectual property or proprietary right of any third party.
5.3.1.3. The content does not contain unlawful, defamatory, obscene, threatening, harassing, discriminatory, hateful, fraudulent, or otherwise prohibited material.
5.3.1.4. The content does not falsely imply sponsorship, endorsement, association, authorization, or affiliation with any person, company, celebrity, team, school, government entity, or organization.
5.3.1.5. The content does not contain confidential or proprietary information that the customer is not authorized to disclose or reproduce.
5.3.1.6. The content does not violate any applicable law, rule, regulation, or court order.
5.4. No Company Liability for Customer Content
5.4.1. Krax Style is not liable or responsible for Customer-Provided Content.
5.4.2. Krax Style is not responsible for determining whether Customer-Provided Content infringes the rights of another party.
5.4.3. Any legal claim, demand, dispute, or liability arising from Customer-Provided Content is the sole responsibility of the customer to the fullest extent permitted by law.
5.5. License Granted to Krax Style
5.5.1. By submitting Customer-Provided Content, the customer grants Krax Style a non-exclusive, worldwide, royalty-free, limited license to reproduce, process, format, resize, edit for technical production purposes, display internally, manufacture, and otherwise use the content solely as necessary to:
5.5.1.1. Review the order
5.5.1.2. Communicate with the customer about the order
5.5.1.3. Produce the customized product
5.5.1.4. Fulfill the customer’s purchase
5.5.1.5. Maintain necessary internal order and compliance records
5.5.2. This license does not transfer ownership of Customer-Provided Content to Krax Style.
5.5.3. Krax Style will not intentionally use Customer-Provided Content for unrelated promotional purposes without separate permission, except where the customer has independently consented to such use.
5.6. Content Screening and Removal
5.6.1. Krax Style may, but is not required to, review Customer-Provided Content.
5.6.2. Krax Style may reject, remove, decline, or refuse to produce any product containing content that it determines, in its reasonable discretion, may:

5.6.2.3. Expose Krax Style or third parties to legal risk
5.6.2.4. Be offensive, abusive, hateful, threatening, or inappropriate

5.7. Indemnification for Customer Content

To the fullest extent permitted by law, the customer agrees to defend, indemnify, and hold harmless Krax Ventures LLC, Krax Style, and their owners, officers, employees, contractors, affiliates, vendors, service providers, and agents from and against any claims, liabilities, losses, damages, judgments, penalties, settlements, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

5.7.1.2. Alleged or actual infringement of third-party rights
5.7.1.3. The customer’s violation of these Terms
5.7.1.4. The customer’s violation of applicable law
5.7.1.5. The customer’s misuse of any product or service
5.8. Copyright and Intellectual Property Complaints
5.8.1. Krax Style may respond to intellectual property complaints, including copyright notices, in a manner consistent with applicable law.
5.8.2. Krax Style reserves the right to suspend, restrict, or terminate customer access where it reasonably believes a customer repeatedly submits infringing or unauthorized content.
6. Prohibited Customization Content
6.1. Intellectual Property Violations
6.1.1. Customers must not submit content containing third-party intellectual property unless the customer has all necessary rights and permissions.
6.1.2. Examples may include, without limitation:
6.1.2.1. Brand logos
6.1.2.2. Movie, television, anime, or cartoon characters
6.1.2.3. Music artist branding
6.1.2.4. Sports team names, logos, or mascots
6.1.2.5. School, university, or fraternity/sorority marks
6.1.2.6. Celebrity names, images, signatures, or likenesses
6.1.2.7. Copyrighted artwork, photographs, or illustrations

6.1.3. Customers remain responsible for ensuring their content does not violate copyright, trademark, patent, publicity, privacy, or any other applicable legal rights.
6.2. Illegal or Harmful Content
6.2.1. Customers must not submit content that:
6.2.1.1. Promotes criminal activity
6.2.1.2. Threatens or encourages violence
6.2.1.3. Harasses, bullies, or defames any person or group
6.2.1.4. Contains unlawful hate speech or discriminatory abuse
6.2.1.5. Exploits or sexualizes minors
6.2.1.6. Contains non-consensual intimate imagery
6.2.1.7. Violates privacy or publicity rights
6.2.1.8. Impersonates another person, organization, or authority
6.2.1.9. Includes fraudulent certifications, counterfeit markings, or misleading commercial claims
6.3. Misleading Origin or Certification Claims
6.3.1. Customers must not submit wording, labels, badges, or designs that falsely claim or imply a product is “Made in USA,” officially certified, government-approved, or endorsed by a third party where such claims are inaccurate or unsupported.
7. Customization Accuracy and Design Approval
7.1. Customer Review Obligation
7.1.1. The customer is solely responsible for reviewing all product details before submitting an order.
7.1.2. This includes reviewing:
7.1.2.1. Spelling
7.1.2.2. Grammar
7.1.2.3. Names
7.1.2.4. Dates
7.1.2.5. Numbers
7.1.2.6. Uploaded image quality
7.1.2.7. Placement
7.1.2.8. Color selection

7.1.2.11. Quantity
7.1.2.12. Customization instructions
7.2. Proofs, Previews, and Mockups

7.4. Image Resolution and Quality
7.4.1. Customers are responsible for uploading files that are sufficiently clear, high-resolution, and appropriate for the chosen product size and print area.
7.4.2. Krax Style is not responsible for pixelation, blurriness, distortion, low contrast, poor cropping, or other quality issues that result from customer-provided files or instructions.
7.5. Production Adjustments
7.5.1. Krax Style may make minor technical adjustments reasonably necessary for production, including resizing, repositioning, formatting, print-safe spacing, or file conversion.
7.5.2. Such adjustments do not obligate Krax Style to redesign, improve, or correct Customer-Provided Content unless Krax Style separately agrees to perform design services.
8. Product-Specific Terms: Apparel Products
8.1. T-Shirts
8.1.1. T-Shirts may vary slightly in color, thickness, texture, and fit depending on supplier batch, fabric composition, and size.
8.1.2. Printed or applied designs may feel or appear different depending on garment color, fabric weave, and selected customization method.
8.1.3. Customers are responsible for reviewing size charts before ordering.
8.1.4. Design placement may vary slightly due to normal production tolerances.
8.1.5. Krax Style is not responsible for customer errors in spelling, artwork placement, uploaded file quality, or size selection.
8.2. Hoodies
8.2.1. Hoodies may include natural garment variations in fleece texture, thickness, drawstring appearance, seams, and pocket alignment.
8.2.2. Printed or customized areas may vary slightly due to fabric stretch, thickness, seams, or pocket placement.

8.2.4. Krax Style may decline requested placements that are technically unsuitable for production.

8.3.2. Large or unusually shaped designs may require resizing or repositioning for production feasibility.

8.4. Pants
8.4.1. Pants may have limited or specialized customization zones depending on product style, seams, pockets, cuffs, panels, and garment construction.
8.4.2. Design placement may vary slightly between left/right sides or between sizes due to garment dimensions and production alignment.
8.4.3. Customers must review all measurements and sizing information carefully before ordering.
8.4.4. Krax Style may refuse designs or placements that are not technically feasible or that may materially compromise the quality of the finished product.
8.5. Sport Jerseys
8.5.1. Sport jerseys may include customized names, numbers, artwork, logos, and other visual elements only where the customer has lawful authority to use such content.
8.5.2. Customers must not submit professional league, team, school, athlete, or organization branding unless they have all required rights and permissions.
8.5.3. Number styles, name placement, and design proportions may vary slightly depending on jersey size, material, and production method.
8.5.4. Krax Style does not guarantee that a personalized jersey design will replicate any official team or league uniform.
8.5.5. The customer is responsible for verifying the spelling of names, initials, titles, and numbers before order submission.
9. Product-Specific Terms: Bag Products

9.1.1. Tote bags may vary slightly in fabric tone, weave, seam structure, handle placement, and print surface texture.
9.1.2. Design placement may vary slightly due to bag construction and natural differences in textile panels.

9.1.4. Krax Style is not responsible for artwork details that become difficult to reproduce due to the limits of the chosen tote bag material or print area.

10. Product-Specific Terms: Drinkware Products

10.2. Wine Glass Tumblers

10.2.2. Digital previews may not fully reflect how a design curves around the finished tumbler.

10.2.4. Krax Style may resize, reposition, or slightly adjust artwork for technical production requirements without altering the essential customer-provided content.
10.2.5. Customers should avoid submitting designs that rely on exact edge-to-edge synchronization unless such synchronization is specifically confirmed in writing by Krax Style.
10.3. Stainless Steel Insulated Tumblers
10.3.1. Stainless steel insulated tumblers may include product contours, handles, lids, seams, curved walls, and finishing surfaces that affect customization placement.
10.3.2. Artwork may appear differently depending on whether the tumbler has a matte, gloss, powder-coated, metallic, or dark-colored finish.
10.3.3. Krax Style does not guarantee that digital colors will reproduce identically on stainless steel surfaces.
10.3.4. If a customer chooses a full-wrap or large-format design, the customer acknowledges that normal seam placement, edge transition, or curvature may create slight alignment differences.
10.3.5. Customers are responsible for ensuring that all images, text, and logos requested for tumbler customization are legally authorized for use.
11. Special Edition Products

11.1.2. Availability may be limited by quantity, launch period, supplier availability, or production capacity.
11.2. Design and Availability Changes

11.2.2. Krax Style may limit purchases of special edition products to prevent abuse, resale manipulation, or inventory disruption.
11.3. No Implied Collectible Value

19. Limitation of Liability
